These Terms of Use (“Terms”) govern your access to and use of the AtlantisSync website, applications, and services (collectively, the “Services”). The Services are provided by LaunchPad TX, LLC, a Texas limited liability company (“AtlantisSync,” “we,” “us,” or “our”). Please read these Terms carefully.

1. Acceptance of these Terms

By creating an account, or by accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you are using the Services on behalf of a business or other entity, you represent that you are authorized to bind that entity, and “you” refers to that entity. If you do not agree, do not use the Services.

2. Accounts and eligibility

  • You must be at least 18 years old and able to form a binding contract.
  • You are responsible for the accuracy of your account information and for keeping your login credentials confidential.
  • You are responsible for all activity that occurs under your account, including activity by your team members and any technicians you invite.
  • Notify us promptly at support@atlantissync.io of any unauthorized use of your account.

3. Acceptable use

You agree not to, and not to permit anyone to:

  • Use the Services in violation of any applicable law or regulation, including telemarketing, messaging, and consumer-protection laws (such as the TCPA) and mobile carrier requirements.
  • Send messages to any recipient who has not provided the required consent, or continue messaging a recipient who has opted out.
  • Send unlawful, misleading, harassing, or fraudulent content, or content that infringes others’ rights.
  • Attempt to gain unauthorized access to the Services, other accounts, or our systems, or interfere with the operation or security of the Services.
  • Reverse engineer, resell, or misuse the Services except as expressly permitted.

You are solely responsible for obtaining and maintaining valid consent from your own customers before sending them messages through the Services, and for honoring opt-out requests.

4. Subscriptions, plans, and payment

  • Plans. The Services are offered on monthly subscription plans, currently priced at $99, $299, and $499 per month depending on the plan selected. Current plan features and pricing are shown in the app at the time of purchase and may change on a going-forward basis.
  • Billing. Subscriptions are billed in advance on a recurring monthly basis through our payment processor, Stripe, and renew automatically until cancelled. You authorize us and Stripe to charge your payment method for all applicable fees.
  • SMS credit packs. Text messaging is powered by prepaid SMS credits sold in packs. SMS credits are prepaid and non-refundable, do not expire into cash value, and have no monetary value outside the Services.
  • Cancellation. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. Except where required by law, subscription fees already paid are non-refundable.
  • Taxes. Fees are exclusive of taxes, which you are responsible for where applicable.
  • Payments you collect from your customers. If you use the Services to accept payments from your customers, those payments are processed by Stripe under your connected Stripe account and Stripe’s terms. You are responsible for your prices, taxes, refunds, and disputes with your customers. Before saving a customer’s card or charging a saved card, you must obtain the customer’s authorization as required by law and card network rules, and keep a record of it. AtlantisSync does not store full card numbers.

5. Messaging Terms

This section describes the AtlantisSync messaging program and applies to text messages sent through the Services.

  • Program. AtlantisSync notifications — service, appointment, and job reminders; technician en-route alerts; job-complete and receipt messages; and payment links — sent by AtlantisSync (operated by LaunchPad TX, LLC) on behalf of a Business to that Business’s customers who have opted in.
  • How you opt in. You start by requesting service from a Business: submitting its online request form, or calling or visiting it. You may then agree to receive texts from AtlantisSync, either by ticking an optional, unchecked-by-default box when you enter your own number, or by telling the Business’s staff, who must read you the required statement and record your answer. Consent is not a condition of purchase. See an example of the opt-in.
  • Opting out. Reply STOP to any message to unsubscribe. You will receive one final message confirming you have been unsubscribed, and no further messages will be sent.
  • Message and data rates may apply.
  • Message frequency: recurring; frequency varies based on your service activity.
  • Customer support: for help with the messaging program, contact support@atlantissync.io.
  • Reply STOP to cancel. Reply HELP for help.
  • Carriers are not liable for delayed or undelivered messages.
  • No mobile information will be shared with third parties or affiliates for marketing or promotional purposes; text-messaging opt-in data and consent will not be shared with any third parties. See our Privacy Policy.

6. Customer data and privacy

Our collection and use of information is described in our Privacy Policy. As between you and us, you retain ownership of the data you and your customers submit to the Services, and you grant us the rights needed to host and process that data to provide the Services.

7. Third-party services

The Services rely on third-party providers including Stripe (payments), Twilio (messaging), and Supabase (infrastructure). Your use of features that depend on these providers may also be subject to their terms. We are not responsible for third-party services we do not control.

8. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT MESSAGES WILL BE DELIVERED.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATLANTISSYNC AND LAUNCHPAD TX, LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

10. Indemnification

You will indemnify and hold harmless AtlantisSync and LaunchPad TX, LLC from claims, damages, and expenses arising out of your use of the Services, your content, or your violation of these Terms or of applicable law — including claims arising from messages you send without proper consent.

11. Suspension and termination

We may suspend or terminate your access to the Services if you violate these Terms, if required to protect the Services or other users, or as otherwise permitted by law. You may stop using the Services at any time. Provisions that by their nature should survive termination will survive.

12. Changes to the Services or Terms

We may modify the Services or these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Texas for any dispute arising out of or relating to these Terms or the Services, except where applicable law provides otherwise.
